Terms of use

These Terms of use outline the agreement between you (“the customer”) and Memory Lane Images (“we”, “us”, “our”) when using our scanning, digitising, and related services. By placing an order with us, you acknowledge that you have read, understood, and agreed to the terms below.

1. What we do

Memory Lane provides services including:

• Scanning and digitising printed photographs, negatives, slides, video formats, and related media.
• Light image enhancement such as rotation, cropping, and basic colour/clarity improvements.
• Delivery of completed digital files via a secure online gallery and/or physical USB (when selected).

We may decline to scan items that cannot be safely processed, including items that are excessively damaged, stuck together, mould-affected, or outside our equipment’s size/format limits. When this occurs, you will not be charged for those items.

2. Your responsibilities

Sending your originals
Customers are responsible for safely packaging their materials before sending them to us or handing them over for collection. We strongly recommend tracked postage for peace of mind. Memory Lane is not responsible for items lost or damaged before they reach our possession.

Ownership & Permission
By submitting materials to us, you confirm that you own the originals or have permission to have them reproduced.

Condition of Items
We take great care with every order, but we cannot be responsible for pre-existing damage, fragility, or deterioration that may affect the scanning outcome.

3. Payments and billing

Deposit
A 25% deposit is required when placing your order. Once scanning has commenced, this deposit becomes non-refundable.

Final Payment
You authorise us to charge the remaining balance to the same payment method once scanning is complete and the final quantity of scans is confirmed. If the payment fails, we will notify you and payment must be completed within 7 days.

Payment Methods & GST
Payments are processed securely through Stripe using debit/credit cards.
Memory Lane is registered for GST. Prices are listed excluding GST; GST is added at checkout.

4. Delivery of completed work

Digital Delivery
Your completed scans will be delivered via a secure online gallery link sent to the email address you provide. Please ensure your email is entered correctly.

USB Delivery
If requested, we can supply digital files on a USB device.

Return of Originals
We return your originals either via personal delivery (where available) or Australia Post Parcel Post. Estimated delivery times and any costs will be confirmed when your order is accepted. While we make every effort to meet expected timelines, delays outside our control may occur.

5. Cancellations and refunds

Cancelling an Order
If you need to cancel, let us know as soon as possible. If scanning has started, the deposit is non-refundable and additional fees may apply for work already completed.

Refunds
Refunds are only issued where we are unable to complete your order or in exceptional circumstances determined at our discretion.

6. Data retention

We retain a backup of your digital files for 90 days after your order is completed to assist with any re-delivery or enquiries. After this period, files are securely removed from our system unless you choose to extend your storage.

7. Handling of originals

We treat every order with extreme care. However, some risks are inherent when working with ageing, fragile, or deteriorating materials.

Memory Lane is not responsible for:

• Damage resulting from pre-existing fragility, mould, adhesives, or deterioration.
• Loss or damage to items during transit to or from our premises (unless handled directly by us).
• Loss of digital files after they have been delivered to you.

In the unlikely event of loss or damage while originals are in our possession, we will work with you to reach a fair and reasonable resolution.

8. Privacy

We respect your privacy. Personal information is used solely for processing your order, returning your materials, and communicating with you. We do not share your information with third parties except where required to fulfil your order.

9. Copyright and usage

You retain full ownership of your original materials and the digital versions we produce.

By using our service, you grant us permission to handle, scan, store, and deliver your images solely for the purpose of completing your order.

We will never use your images for marketing or any other purpose without your clear, written permission.

10. Changes to these terms

Memory Lane may update these Terms & Conditions from time to time. Any changes will take effect immediately upon being posted on our website.
